WASHINGTON (March 27, 2020) – As the House of Representatives’ voted Friday to send a historic COVID-19 relief package to President Trump, the National Association of Realtors® published a comprehensive guide (link is external)to the $2 trillion, 880-page bill educating Realtors® on the many benefits secured by NAR. Real Estate License Renewal and CE Requirements Extended

License renewal and continuing education requirements for real estate brokers and salespersons have been delayed 90 days, according to the Pennsylvania Department of State’s Bureau of Professional and Occupational Affairs.

The bureau announced the delay today as a result of the coronavirus pandemic. Renewals and continuing education requirements will now be required by Saturday, Aug. 29, 2020. Read more

Governor Authorizes Temporary Use of Remote Online Notarization

A temporary notarial rule suspension to allow for remote online notarization of documents in a limited category of real estate transactions was approved by Gov. Tom Wolf this week.

For residential real estate transactions, the new rule only applies to transactions that were already in process (e.g. agreement of sale completed for residential property and only final closing needs to take place) at the time of the governor’s declared state of emergency due to the coronavirus pandemic on March 6. PAR Officers: Follow Governor’s Order

The ongoing debate amid the COVID-19 pandemic is whether real estate should be classified as life sustaining. Under the order by Gov. Tom Wolf, all non-life sustaining businesses in Pennsylvania were asked to close their physical locations as of 8 p.m. on March 19 to slow the spread of COVID-19. Hospitals, pharmacies, grocery stores, medical facilities, government services and banking/financial services were deemed life sustaining in this crisis and are able to continue to operate. Real estate services were not categorized as life sustaining. PAR continues to work to get answers for Realtors® as we receive coronavirus business restriction updates, but we wanted to make you aware of information issued yesterday.

Discussions with the governor’s office continue, but have thus far not resulted in industry-wide waivers for real estate practice. In his Sunday address, Gov. Wolf did say companies could apply for a waiver if they believe their business was incorrectly classified as not being life-sustaining.

Many questions have been raised about whether settlement companies can proceed, and if so, under what circumstances. Some have interpreted the guidance from the governor, especially as it relates to credit intermediaries and insurance agencies, to mean they can continue to do business. This could result in many of you seeing different practices being used across the state. You should contact your title company to determine whether they will do business in the days ahead. I would imagine that you are focused on little more than a single issue these days.  I will therefore keep this short.

There are more questions than answers.  This will change and I suggest that you continue to monitor the Pennsylvania Association of Realtors®’ online publication JustListed.  PAR is working tirelessly to provide you with the latest,  consider forms solutions and to provide other answers.  I suggest you go to parealtor.org/coronavirus to view frequently asked questions and whatever else may be published there.

The transactions that are pending may or may not settle and much depends upon the cessation of business, including the closure of the recorder of deeds in the counties of Pennsylvania.  The Pennsylvania Supreme Court has issued an order calling for the closure of the common pleas courts and all functions except those that are deemed essential.  The Supreme Court’s order does not define the functions of the recorder of deeds as essential for purposes of closure.  Information about the local courts can be found at http://www.pacourts.us/ujs-coronvirus-informationRead more

The last few days have been extremely trying and chaotic for so many of us. Trying to help our clients during a pandemic is probably one of the greatest challenges we’ll ever face.

I wanted to let you know how incredibly hard your association has been working on your behalf and how we’re continuing to advocate for homeownership. PAR’s leadership team, staff and local association executives have had numerous conference calls and countless texts and emails since the governor’s order on Thursday and will continue to be in constant communications as long as needed. 

The association has been contacting the governor’s office, legislators, the Bureau of Professional and Occupational Affairs and the Real Estate Commission, looking for clarification on Gov. Wolf’s recent restrictions issued to mitigate the spread of the coronavirus. We filed an appeal requesting that the governor re-classify real estate as a life-sustaining industry, but the governor’s revised guidance issued on Friday afternoon changed little for real estate. We will continue to press the need for relief for your clients who are nearing settlement/moving deadlines and for greater clarity for other real estate service providers.

We have teamed up with seven associations — the Pennsylvania Land Title Association, Pennsylvania Builders Association, Pennsylvania Bankers Association, Pennsylvania Association of Community Bankers, Pennsylvania Apartment Association, Pennsylvania Residential Owners Association and Pennsylvania Credit Union Association — representing nearly 50,000 members, to advocate for the real estate industry and our clients. We’ve asked the governor to issue an executive order or otherwise support legislation to allow electronic notarization. Read more

The leadership and staff of the Pennsylvania Association of Realtors® have been working non-stop to get answers for you and your clients

PAR released the new Form COVID, an updated Change in Terms Addendum (Form CTA) and a new Wire Fraud Notice (Form WFN) on Thursday evening. To read more about these forms, visit PARealtors.org.

Additionally, we have been updating the Frequently Asked Questions on PARealtors.org/coronavirus daily, sometimes hourly. If you have questions, please visit the FAQ first. 

At this time, best practice is to explore offering virtual services, as much as possible, so as to avoid face-to-face personal contact, or to stop these sorts of activities altogether. The governor’s order will not be legally enforced until 8:00 a.m. on Monday, March 23, however, delayed enforcement is not the same as saying the order does not apply. The best advice is to contact all related providers to determine whether they are operating and consult brokerage counsel to discuss what steps can be taken to conduct business while staying in compliance with the closure order.

COVID-19 Addendum Available for Use

On Thursday, March 19, Gov. Wolf issued an order that all “non-life sustaining businesses” in the state should shut down to slow the spread of COVID-19. Per that guidance, all real estate sales and leasing businesses have been ordered to close their physical locations until further notice, although the order “does not apply to virtual or telework operations (e.g., work from home), so long as social distancing and other mitigation measures are followed in such operations.”

As we understand the governor’s order, then, real estate brokers and agents can continue to conduct whatever activities they can remotely, but should not be in an office and should likely avoid going to client homes to conduct business. Keep in mind as well that most other real estate-related activities are under similar orders, so almost all third-party providers (lenders, appraisers, inspectors, contractors) will be affected in the same way. SRA Municipal Update: As Local Governments Close, What Happens to Property Sales?


Here's a sampling of what we've been hearing from members since the coronavirus hit our region:

"I have a closing scheduled on March 25, but we need a re-inspection and the borough office just closed."

"The township just told me they are not conducting U & O inspections."

"Since they won't inspect, they want my buyer to sign a waiver saying she'll be responsible for any repairs they require after the sale."


Here are examples of municipalities finding a way to get the job done, even during the crisis:

“We are continuing with external inspections of properties, but we would love to see pictures if possible for the smoke detectors, fire extinguisher, handrails and relief valve on the water heater. If needed, we will issue a conditional U&O for the property.”

“We are continuing our inspections, but will only enter buildings if they are unoccupied in an effort to protect our staff and avoid spreading the virus.”  Read more

Updates on COVID-19 and Real Estate in Pennsylvania

You’ve got questions. Lots of questions.

At this point, things are changing day by day – sometimes even hour by hour. And since real estate transactions are dependent on so many third-party service providers, the complexity of each individual question is complicated by many orders of magnitude. To be perfectly honest, right now we have just as many questions as you do, and very few firm answers.

But we’re working on it. Even if you can’t see the results just yet, PAR is working hard to get information and answers to help our members and their clients in these difficult times. Here’s a snapshot of the things we’ve been doing, and some tips on the sorts of questions you should be asking about your transactions to assess how to move forward the best that you can.

License Renewal/Continuing Education

The current license renewal cycle ends on May 31, so licensees ordinarily would need to complete continuing education and complete their renewals through the Department of State’s Pennsylvania Licensing System (PALS) by that date. Many members have asked if these deadlines will be extended now that the relevant state offices are closed or cut back and most real estate schools have canceled in-person classes. Due to recent restrictions and recommendations implemented by the federal and Washington, D.C. governments, NAR will deliver previously-planned programming and committee meetings virtually.

With the Centers for Disease Control issuing guidance limiting discretionary travel and gatherings of more than 10 people for the next eight weeks, and Washington, D.C. also instituting a state of emergency to limit the spread of COVID-19, we will no longer hold the 2020 REALTORS® Legislative Meetings and Trade Expo in person from May 11-16 in Washington, D.C. In light of the COVID-19 outbreak emergency, I would like to encourage paper
document submitters to consider taking advantage of the electronic recording (e -
recording) service that we offer for land record or Powers of Attorney documents.
Use of this service will eliminate the need for any walk-in, US Mail or express mail
submissions. For the next two weeks, the 15 cents/minute fee has been waved to encourage online searching.  Click here for the full update.

Real Estate Companies Respond to Coronavirus Restrictions

New restrictions imposed by Gov. Tom Wolf over the past several days to help mitigate the spread of the coronavirus have caused Pennsylvania brokers and Realtors® to rethink how to serve their clients.

On Monday, Wolf issued guidance on essential and non-essential businesses after urging non-essential businesses to close for at least 14 days to mitigate the spread of the disease. The lists could never be comprehensive, and real estate is one of many services not listed in either category. But the latest guidance does say other businesses, including but not limited to legal services, business and management consulting, professional services and insurance services are encouraged to have employees work remotely or telecommute. If that is not possible, they should employ social distancing best practices and be aware of the Trump administration’s guidance to avoid gatherings of 10 or more people. Read more



An update from the Suburban REALTORS® Alliance

In response to the coronavirus/COVID-19 outbreak in our region, the Suburban Realtors® Alliance office in Malvern is temporarily closed, but our work continues uninterrupted.

Alliance staff are working remotely, starting this week through the end of March. We continue to monitor the news and legal notices for any issues that could affect the members of our three shareholder associations. Our municipal database remains online. We are in contact with government officials to ensure necessary public health measures cause as little disruption to real estate as possible.

An update from the Pennsylvania Association of REALTORS®

As COVID-19 has begun spreading throughout Pennsylvania and with Gov. Tom Wolf’s state-of-emergency declaration, we understand that many things are uncertain at this time.

The Pennsylvania Association of Realtors® staff will be working remotely for at least the next several weeks. We will continue to provide services to you, however, you may experience a delay when calling the association. Be assured that our staff will return your call and the PAR Legal Hotline will continue to operate. In addition, the association has suspended in-person activities and events, which are posted on this webpage, PARealtors.org/coronavirus.

We were notified that the State Real Estate Commission offices in Harrisburg are closed and employees are working remotely. You may experience delays if you’re contacting them.

PAR is advocating for you with the state. We have requested that the state change or delay the license renewal and continuing education deadline. We will keep you informed as soon as any decisions are made.

We have already received a number of calls regarding practice issues like open houses and closing delays. PAR is working on resources for you to use, which will be available on PARealtors.org/coronavirus. As a statewide organization, we’ve seen specific market conditions that vary greatly across the state. While we can provide general advice on certain aspects of these events, we are unable to give specific advice on how to handle individual transactions. Based on the governor’s declaration of essential business operations, PAR recommends agents and brokers discuss the impacts on each transaction to decide the best course of action.  Read more

Corona Virus Emergency Legislation-What REALTORS need to know

Congress is speeding toward the passage of emergency coronavirus legislation.  The bill passed by a wide margin early Saturday in the House and is headed to the Senate next week, where it is expected to pass easily.  You can find a summary prepared by NAR staff here.

Governor Wolf has provided COVID-19 mitigation guidance for Bucks County for two weeks with a possible extension. As a result, the Bucks County Association of REALTORS® office will be closed. All employees will be working remotely. We look forward to providing you with the same extraordinary service. BCAR is fielding many questions from our members regarding license renewal. As of today, per the Pennsylvania Real Estate Commission, all agents licensed before 12/1/2019 are required to complete 14 hours of continuing education by May 31, 2020.

 3/12/2020- BCAR’s response to COVID-19 (Coronavirus) 

In response to growing evidence and concern regarding the COVID-19 (coronavirus) pandemic, the Bucks County Association of Realtors® is taking the precautionary step to suspend in-person meetings, events and classes starting Friday, March 13 through Friday, April 10.

BCAR has posted on its website calendar the scheduled meetings, events and classes that have been affected by this decision. If you are currently registered for a meeting, event or class during this period, you will also receive direct notification with information on possible alternate dates, refunds, etc.

As of today, staff continue to work from the BCAR building but they are prepared and trained, if necessary, to work remotely and continue providing excellent, uninterrupted service to our members.

BCAR leadership and staff will continue to closely monitor and evaluate the situation during this period to decide if future events will be affected and will stay in contact with members on a regular basis.

“BCAR is fully committed to the safety and well-being of our members along with that of the communities we serve. BCAR’s action is based on similar actions taken by PAR, NAR and other organizations across the country.” said BCAR President Scott Geller.
